SIIA Submits Letter to Lawmakers Opposing Illinois Data Privacy and Protection Act

The Software and Information Industry Association (SIIA) has submitted a letter opposing HB3041, the Illinois Data Privacy and Protection Act, urging lawmakers to align the bill with widely accepted state privacy laws rather than the American Data Privacy and Protection Act (ADPPA). While SIIA supports comprehensive privacy protections, it highlights concerns with HB3041’s approach, including its treatment of publicly available data, novel fiduciary duties, and the inclusion of a private right of action. Instead, SIIA recommends Illinois follow the established frameworks of states like Virginia and Connecticut to ensure consistency for both consumers and businesses.
