SIIA Joins Organizations in Opposing Maryland SB 362 on Forged Digital Likenesses

The Software and Information Industry Association (SIIA) joins Chamber of Progress, Engine, and Public Knowledge in opposing Maryland’s SB 362, which seeks to criminalize the distribution of “forged digital likenesses.” The bill’s vague language and broad scope raise significant First Amendment concerns, potentially chilling lawful speech, satire, and online expression. The legislation lacks clear definitions and could subject individuals and organizations to severe penalties without due notice. While addressing deepfakes is important, this bill is not the right solution. SIIA urges lawmakers to reject SB 362 and pursue a more balanced approach that protects both free expression and Maryland consumers.
