The Software & Information Industry Association (SIIA) has submitted a letter to Maryland lawmakers expressing concerns about HB1089, the Building Information Guardrails Data Act of 2025. While intended to regulate data brokers, the bill’s broad definitions could unintentionally include businesses with direct consumer relationships, creating regulatory uncertainty. Additionally, the proposed tax on data-related activities, including those occurring outside Maryland, raises constitutional and economic concerns. SIIA warns that such a tax could drive businesses out of the state, negatively impact consumers, and face legal challenges under the First Amendment. We urge lawmakers to reconsider this approach and welcome the opportunity for further discussion.
